These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and The THC Shop powered by Coastal Herb (the “Company,” “we,” “us,” or “our”), governing your access to and use of the website located at https://thcac.com, any subdomains, and all related services, systems, software, point-of-sale platforms, delivery services, loyalty programs, communications, and in-store or online transactions (collectively, the “Services”).

THE SERVICES ARE STRICTLY LIMITED TO INDIVIDUALS TWENTY-ONE (21) YEARS OF AGE OR OLDER. By accessing or using the Services, you represent, warrant, and covenant that you meet this requirement and are legally permitted to engage in cannabis-related transactions under applicable law.

1. ACCEPTANCE AND MODIFICATION OF TERMS

By accessing, browsing, purchasing from, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must immediately discontinue use of the Services.

The Company reserves the unilateral right to modify, amend, suspend, or terminate these Terms at any time, with or without notice. Continued use of the Services following any modification constitutes acceptance of the revised Terms.

2. LEGAL COMPLIANCE AND REGULATORY ACKNOWLEDGMENT

The Company operates in a highly regulated industry. You agree to comply with all applicable federal, state, and local laws, including New Jersey cannabis regulations, age-verification requirements, purchase limits, and consumption restrictions. Nothing herein authorizes conduct prohibited by law.

The Company may deny service, cancel transactions, or restrict access at its sole discretion to maintain compliance or protect its license.

3. ELIGIBILITY AND AGE VERIFICATION

You affirm that you are at least twenty-one (21) years of age. The Company reserves the right to require government-issued identification at any time and to refuse service where eligibility cannot be verified. Any attempt by a minor to access or use the Services constitutes unauthorized use.

4. ACCOUNT REGISTRATION AND SECURITY

Certain Services may require account creation. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your login credentials. You are solely responsible for all activity conducted under your account, whether authorized or unauthorized.

The Company shall not be liable for losses arising from unauthorized account access resulting from your failure to safeguard credentials.

Payments are processed through third-party processors. The Company does not store full payment card numbers and disclaims liability for acts or omissions of payment processors.

6. DELIVERY AND PICKUP TERMS

Delivery services, where offered, are subject to geographic restrictions, verification requirements, and applicable law. Delivery times are estimates only and not guaranteed. The Company shall not be liable for delays, failed deliveries, or losses caused by incorrect information, recipient unavailability, law enforcement action, or force majeure events.

Risk of loss transfers to you upon lawful completion of delivery or pickup.

7. LOYALTY PROGRAMS AND PROMOTIONS

Participation in loyalty programs or promotions is voluntary and subject to additional terms, which may be modified or terminated at any time. Loyalty points or rewards have no cash value and may be forfeited for misuse or regulatory reasons.

8. PROHIBITED CONDUCT

You agree not to:

Violate any applicable law or regulation;
Attempt to circumvent age verification or purchase limits;
Engage in resale or diversion of cannabis products;
Interfere with or disrupt the Services;
Use the Services for fraudulent, abusive, or unlawful purposes.

Violation of this section may result in immediate termination of access and referral to authorities.

9. INTELLECTUAL PROPERTY

All content, trademarks, logos, designs, text, graphics, and software associated with the Services are the exclusive property of the Company or its licensors and are protected by intellectual property laws. No rights are granted except as expressly set forth herein.

10. DISCLAIMER OF WARRANTIES

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. ASSUMPTION OF RISK

You acknowledge that cannabis use involves inherent risks and agree that you assume all responsibility for lawful consumption, storage, and use of any products purchased.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its owners, officers, employees, affiliates, and agents from all claims, damages, losses, liabilities, and expenses arising from your use of the Services, violation of these Terms, or violation of law.

14. TERMINATION

The Company may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected violations of these Terms or applicable law.

15. GOVERNING LAW AND VENUE

These Terms shall be governed exclusively by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute shall be brought solely in the state or federal courts located within New Jersey, and you consent to such jurisdiction.

16. SEVERABILITY; WAIVER

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any provision shall not constitute a waiver.

17. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding use of the Services and supersede all prior agreements or understandings.
